1 INTERPRETATION


In these Conditions:

|Art| means the items sold by Lighthouse Art to the Customer under the Contract.

|The Artist| refers to Karin van der Plas.

|Contract| means these Conditions, the Lighthouse Art Customer Order Form and any other document that the parties agree in writing will form part of the contract.

|Customer| means the person so named on the Lighthouse Art Customer Order Form and anyone reasonably appearing to Lighthouse Art to be acting with that person's authority or permission.

|Premises| means the place where the Art will be delivered.


2 GENERAL


2.1 This Contract cannot be varied without the written agreement of the parties.

2.2 Any warranty, statement or promise regarding the Art is only valid if given in writing by Lighthouse Art.

2.3 Unless the Customer relies on Lighthouse Art's written advice, the Customer is responsible for ensuring that the Art is suitable for its needs.


3 COPYRIGHT


3.1 Copyright in the Artwork remains the property of the Artist, Karin van der Plas.

3.2 The work may not be adapted or reproduced or submitted for publication in any form, including any Internet website at any time without the prior written permission of the Artist.


4 COMMISSIONS


4.1 All Lighthouse Art commissioned pieces are guaranteed to be original, one off pieces produced to the customer's brief. The brief to include measurements, style of work and painting technique and any other specific instructions from the Customer.

4.2 The brief will be agreed in writing and will include a price quotation. Upon acceptance of the brief the Customer is required to pay a 50% non-refundable deposit before work can commence. A further 25% becomes due on completion of the work and the final 25% upon acceptance of the work by the Customer.

4.3 If the Commission is not accepted or paid for in full on completion Lighthouse Art reserves the right to sell the art work by whatever means it chooses.


5 SPECIAL ORDERS


5.1 A detailed specification to include price quotation will be agreed by both parties in writing. Upon acceptance of the quotation the Customer is required to pay a 50% non-refundable deposit. The remaining 50% is due when the item is ready for despatch.


6 DELIVERY


6.1 Lighthouse Art will use reasonable endeavours to provide the Art by the date agreed with the Customer but all dates are estimates and Lighthouse Art has no liability for any failure to meet any date.

6.2 Paintings are supplied 'ready to hang'.

6.3 Lighthouse Art uses 'The British Shop', specialists in shipping artworks, to deliver orders to Premises specified by the customer.

6.4 Customers wishing to make their own collection or delivery arrangements should contact Lighthouse Art to agree the details. Lighthouse Art strongly advises Customers making their own arrangements to insure items in transit as Lighthouse Art will not be responsible for damage once the item has left our studio.

6.5 T-shirts and fine art paper prints will be sent by Royal Mail and will usually be delivered within 4-7 working days.

6.6 International customers should contact us prior to purchase to discuss cross border financial and customs arrangements and to establish accurate shipping charges.


7 GUARANTEE


7.1 Lighthouse Art guarantees that all its products are derived from original art work by Karin van der Plas.


8 REFUNDS AND EXCHANGES


8.1 Customers should inspect their shipments on receipt. If any item was damaged in transit the Customer must file a claim immediately with the shipping company.

8.2 With the exception of Commissioned pieces Lighthouse Art offers an exchange or refund of the artwork cost within 7 days of the Customer receiving their artwork where the customer is not satisfied for any other reason than damage in transit. Items must be returned via 'The British Shop' in the original packing materials and must be insured by the Customer to the full value of the artwork. Shipping and insurance costs remain the responsibility of the customer. Customers should contact Lighthouse Art prior to returning any items to agree the refund or exchange.

8.3 Where there is a difference in price on an exchanged item an adjustment will be made.


9 PRIVACY POLICY


9.1 Lighthouse Art is committed to protecting your privacy. We only use the information we collect about you lawfully. We do not rent, sell or lease information to third parties.

9.2 Lighthouse never uses 'cookies' for any reason and does not send out 'spam' emails.


10 JURISDICTION


10.1 These Terms and Conditions shall be governed by, and construed in accordance with, English Law. Any disputes shall be subject to the exclusive jurisdiction of the English courts.
